{"id":29166,"date":"2015-09-15T09:43:27","date_gmt":"2015-09-15T08:43:27","guid":{"rendered":"https:\/\/www.prijedordanas.com\/?p=29166"},"modified":"2015-09-15T09:43:27","modified_gmt":"2015-09-15T08:43:27","slug":"podstanarski-zivot-bez-ugovora-pun-rizika","status":"publish","type":"post","link":"https:\/\/www.prijedordanas.com\/?p=29166","title":{"rendered":"PODSTANARSKI \u017dIVOT BEZ UGOVORA PUN RIZIKA"},"content":{"rendered":"<p><a href=\"https:\/\/www.prijedordanas.com\/wp-content\/uploads\/2015\/09\/nezavisne-podstanarski-zivot.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.prijedordanas.com\/wp-content\/uploads\/2015\/09\/nezavisne-podstanarski-zivot-300x200.jpg\" alt=\"nezavisne-podstanarski zivot\" width=\"300\" height=\"200\" class=\"alignleft size-medium wp-image-29167\" srcset=\"https:\/\/www.prijedordanas.com\/wp-content\/uploads\/2015\/09\/nezavisne-podstanarski-zivot-300x200.jpg 300w, https:\/\/www.prijedordanas.com\/wp-content\/uploads\/2015\/09\/nezavisne-podstanarski-zivot-480x320.jpg 480w, https:\/\/www.prijedordanas.com\/wp-content\/uploads\/2015\/09\/nezavisne-podstanarski-zivot.jpg 600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>Mnogi gra\u0111ani koji iznajmljuju stanove u RS ogor\u010deni su jer stanodavci rijetko pristaju na potpisivanje ugovora, \u0161to donosi brojne rizike, poput toga da im kirija poskupi &#8220;preko no\u0107i&#8221; ili da dobiju nare\u0111enje da se isele za nekoliko sati.<\/p>\n<p>Oni koji su prinu\u0111eni na podstanarski \u017eivot u najve\u0107em gradu RS, gdje ima najvi\u0161e podstanara, ali i u ostalim op\u0161tinama, \u010desto tvrde da stanodavci ne po\u0161tuju njihova prava, odnosno da ne \u017eele da ih prijave na adresu stanovanja, a iza toga se, uglavnom, krije izbjegavanje pla\u0107anja poreza.<\/p>\n<p>Veliki problem podstanara je i to \u0161to bez potpisanog dokumenta nisu u mogu\u0107nosti da prijave i mjesto stanovanja, \u0161to opet donosi i druge posljedice, poput toga da su, kada moraju da se periodi\u010dno javljaju Zavodu za zapo\u0161ljavanje RS, prinu\u0111eni da putuju u svoju op\u0161tinu.<\/p>\n<p>Studentkinja medicine Kristina Rendi\u0107 iz Prijedora u Banjaluci \u017eivi posljednjih pet godina i do sada je promijenila \u0161est stanova, a nikada nije bila u prilici da to i ozvani\u010di potrebnim dokumentom.<\/p>\n<p>&#8220;Vi\u0161e puta moji roditelji i ja tra\u017eili smo od stanodavca da potpi\u0161e ugovor, me\u0111utim niko od njih to nije \u017eelio da uradi&#8221;, nagla\u0161ava Rendi\u0107eva.<\/p>\n<p>Ona dodaje da se i pored ugovora koji stanodavci ne \u017eele da potpi\u0161u de\u0161avaju i druge neugodne situacije.<\/p>\n<p>&#8220;Gazde stanova \u010desto isklju\u010duju grijanje u iznajmljenim stanovima ili tokom pregovora o iznajmljivanju stana poka\u017eu jedan namje\u0161taj, a kad se uselim u stan, zateknem sasvim drugi, naravno lo\u0161iji&#8221;, isti\u010de Rendi\u0107eva.<\/p>\n<p>Zbog ovog i mnogih drugih razloga ona smatra da je po\u017eeljno potpisivanje ugovora izme\u0111u stanodavca i podstanara, jer to je jedini na\u010din da se za\u0161tite interesi obje strane.<\/p>\n<p>Dragovan Petrovi\u0107, sekretar Pokreta potro\u0161a\u010da RS, isti\u010de da stanodavci izbjegavaju postpisivanje ugovora sa podstanarima jer im to donosi tro\u0161ak.<\/p>\n<p>&#8220;Kada se ugovor potpi\u0161e, podstanar ima veliku sigurnost, u smislu da, na primer, ne mo\u017ee da mu se di\u017ee iznos stanarine preko no\u0107i i sli\u010dno. Me\u0111utim, stanodavci uglavnom ne prijavljuju podstanare, ne pla\u0107aju porez&#8221;, isti\u010de Petrovi\u0107.<\/p>\n<p>Savjetuje budu\u0107im podstanarima da sa stanodavcem potpi\u0161u bar interni ugovor, koji \u010dak ne mora biti ni ovjeren.<\/p>\n<p>&#8220;Ukoliko bi i jedan i drugi potpisali taj papir, on ima svoju snagu. I kada nije overen, mo\u017ee biti podloga za dokaz. \u010cak i usmeni dogovor je ugovor, naravno ako za to postoji svedok&#8221;, naglasio je Petrovi\u0107.<\/p>\n<p>On isti\u010de da podstanari pri iznajmljivanju stana treba da provjere niz detalja, gdje, izme\u0111u ostalog, spada iznos kirije, ko pla\u0107a re\u017eije, kada se te obaveze ispla\u0107uju i ostalo.<\/p>\n<p>Iz Udru\u017eenja gra\u0111ana DON Prijedor potvr\u0111uju da su dobijali \u017ealbe studenata u Banjaluci nakon \u0161to su ih vlasnici stanova preko no\u0107i istjerivali na ulicu, jer nisu imali potpisan ugovor, i time nisu mogli da ostvare zakonska prava.<\/p>\n<p>&#8220;Svima smo savjetovali da u budu\u0107nosti tra\u017ee potpisivanje ugovora sa stanodavcem jer samo tako, u slu\u010daju kr\u0161enja, mogu ostvariti svoja prava&#8221;, uvjerava Zoran Peto\u0161, projektni koordinator u prijedorskom Udru\u017eenju gra\u0111ana DON.<\/p>\n<p>On podsje\u0107a i na novi Zakon o prebivali\u0161tu, gdje ne mo\u017eete da doka\u017eete prebivali\u0161te bez ugovora sa stanodavcem.<\/p>\n<p>&#8220;Tu je i zakonska obaveza stanodavca da prijavi stanara i pla\u0107a porez. Ako stanujete bez ugovora i niste prijavljeni, smatra se da ste tu ilegalno i samim tim i stanar kr\u0161i zakon.
